1. Definitions for the purpose of these legal terms:

1.1 ”The legal terms for the use of the website www.intuitext.com” stands for any agreement concluded between any person (hereinafter called “the user”) who visits or accesses the website or who whishes to make use in any way of, or actually uses, the service (hereinafter referred to as  “the service”) and SOFTWIN, as owner and administrator of the website and service provider. This agreement establishes the conditions imposed so that any person can visit or access the website www.intuitext.com (hereinafter called “the website”) or can make use in any way of the service offered through the website.

1.2 Content: any document published on the website, as well as fragments/parts of these documents no matter the format: text, graphic, sound, image, movie, programs etc.

1.3 User: anyone who enters the website for any reason, including for posting something, or downloading, using, copying partially or thoroughly documents/files posted on this website.

1.4 It might be necessary to require some personal data such as name, address, e-mail address and telephone number, in order to improve the quality of the services offered by the website, to answer the users’ questions or to keep records of the website traffic.

1.5 Thus, SOFTWIN will safely manage, and only for the specified purposes, the information provided by the users according to the provisions of the Law no. 677/2001 for the protection of persons related both to the processing of personal data and to the free circulation of such data, amended by Law no. 506/2004 regarding the processing of personally-relevant data and the protection of privacy in electronic communication. The present agreement represents a notification for the users that their personal data provided are processed with the aim of offering the best conditions for the service.

1.6 Modification of the agreement
SOFTWIN reserves the right to modify in any way, anytime and any of the provisions of this agreement, without any preliminary notice and without the obligation of fulfilling any other formalities towards users. The sole use or access to any facility offered by the website or by the service, that comes after the execution of the modifications stands for the thoroughly and unconditioned approval of the user. Unacceptance of any of the modifications entails the obligation of the user to stop immediately accessing the website.

7 Applicable Law. Disputes

7.1 The provision of the present agreement are construed and applied according to the Romanian Law.

7.2 The parties accept that in case of disputes regarding the validity of the contract or which result out of its interpretation, application or termination they will be solved amiably by their representatives.

7.3 If the parties fail in reaching an amiably agreement, then, based on written notification of one of the parties to the other, any disputation that result from or is in connection with the present agreement or with the use of the website will be solved by the arbitration of The Court of Commercial Arbitration attached to the Chamber of Commerce and Industry of Romania in accordance with the rules of arbitration procedure of this Court. The arbitration award is final and binding. 

8. The users that publish/send any kind of information on/for this website agree to concede free of charge, without any time limit, at Romanian national territorial level, in the moment of publication/ dispatch, to all the usage rights, arrangement, modification and retransmission of the materials they are contributing with to the website.

9. The users that publish/ send any kind of information on/for this website guarantee and takes the responsibility for the originality of the content, the obligation of not prejudicing in any way the copyright of third parties.  Inobservance of this obligation does not entail the liability of SOFTWIN, it entails the sole liability of those users.

10. Continuation of the access or visit of the website, of any of its pages and/or of the service, as well as of any of its components represents a thoroughly and unconditioned acceptance of the agreement and of any of its provisions, and unacceptance of this agreement and of any of its provisions entails the obligation of that person to stop immediately accessing the website.
